  • CCJ set aside court admitted error. No costs award.

    I had some court forms sent to me a few months back from a parking company. I clearly stated on the forms I do not owe the debt and my wish to defend. This was signed and dated.

    There was another form for admissions.
    I filled in some information on there as I thought it was required.
    I did not sign it.

    low and behold a week letter I get a default ccj.
    I take the company to court today an had the ccj set aside right away.
    the judge says this error is due to the court handling agents who are overworked and in a backlog.

    He made no costs award which I asked for.
    He said he has no power to give me my £330 N244 application money back. But he will send me a letter on the court outcome which will say the Ccj has been made in error by the courts.

    I feel a bit hard done by here. The courts have put me through 3 months of stress and hassle for them to turn around and say yeah you still had to pay £330 but make a complaint to the business centre.

    Anyone come across this before?

    Judge was quite angry with the courts and original claimant it had come to this in the first place and very sympathetic to us.

    Write a formal complaint to the Court Manager. explain exactly what's happened,
    why it's 'unfair' and what you want them to do, refund your fees.

    Remember once you've heard from the Court Manger, if your still not happy,
    you can escalate the complaint.

    The Courts aren't fit for purpose, 'but it is what it is'.
