  • Accepted offer to settle: payment

    I accepted the defendant's offer to settle (not a Part 36 offer), stating that I was doing so in anticipation of payment within 14-days. A Tomlin Order was filed with the Court and the defendant's solicitor confirmed that payment would be made within 14-days. No payment has been made. Can I enforce or chase this debt according to the timeframe I set? Is there scope to seek additional interest? I can find no information outside of Part 36. Many thanks.

    Does the order permit you to apply to the court to enforce the agreed terms? if so, that is your way forward.
