    Please refer to my thread here for some background info, link posted.

    When I replied via the Money Claims Online site I part admitted the claim as it currently stands my intention is to repay the debt. Given the hearing documents were sent to the wrong address I never had visibility of the court date and as such the judge ordered me to pay the money. It is worth noting the claimant never attended either.

    Do we think I am likely to be successful with a set aside on the basis I never had chance to defend myself or is it worth applying for a variation? I am really concerned that they could enforce further action from Friday this week as payment wont be made.

    I have tried to on numerous occasions agree something direct with the claimant but since the judgement they wont entertain it.
