    Ok so I've never used one of these websites before so bear with me!

    I had a very old debt (2004/5) with Welcome Financial Services, commonly known as the lowest of the low. I took out a personal loan for £1500 because my son was born with cerebral palsy and I needed a car for hospital appointments. Long story short over the next few years I religiously paid £150 a month approx. As it was so long ago I had no paperwork and am a bit vague on the details but going by my calculations I reckon I've paid them back over £5000. I know they were infamous for PPI and unfair charges. We moved house and I assumed the debt was settled. Then Nov 2015 I got a letter from Shoosmiths on behalf of Cabot Financial who were going to take me to court saying I still owes £2600.... For a £1500 loan!!! So I let them take me to court and despite only taking one piece of a4 paper, I won and the judge ruled an adjunctment (?) dunno if that's the right word but basically they wanted to dismiss the case and the judge said he was worried they wanted to recall it later so he ruled that it can never be called again! I was elated! Now I would like to claim back PPI and unfair charges if I had them. My question is if it gets awarded, will the amount go towards the £2600 that Cabot say I owe or is that negated by the fact that the ccj went in my favour and the debt to them was written off? I know the best thing to do is get a SAR from welcome to see if I have PPI but do u usually do it all yourself or use one of
    These companies that take a percentage of any claim?

    Hi Mummypig & welcome to Legal Beagles.

    IMHO

    You seem to be not sure of the court's decision on this.
    If it were me, I would phone them & find out the exact status (ie, stayed/struck out etc......I would also ask if there was any indication of the judge's reasons.......you might not get this, but no harm in asking!)

    As for reclaiming PPI, I would not use a Claims Management Co., as it is easy to 'do-it-yourself'

      Firstly do the PPI claim yourself, there is no advantage in using a claims managment company. Any PPI compensation award should go to you and not to what Cabot say you owe.

      Can you post up the court order (or type out the text of it) ?

        I used a recalim company mainly because i am a lazy so and so and despite saying I'll do it next week for five year i still took no action . however the process is verry simple and if welcome are involved then you almost certainly had ppi whether or not you wanted if . PPI was a bonus generator for staff and the interest rate was increased if the customer did not take ppi.

            If I go ahead to claim PPI do I need to obtain paper work first ie SAR request form?

                  If Welcome Finance sold the debt to Cabot then they cannot offset your PPI refund as they no longer own the debt and therefore there is nothing to offset against.

                    What was the date of your 04/05 agreement and was there a separate seller or broker? This is very important because after 14/1/05 you will have to go to the FSCS against the seller. Before this date you would previously have gone to Welcome but they have just announced liquidation proceedings so even if your case is upheld, it will not be paid. But there is a possible workaround to this!! Please post the date and who actually sold you the finance and I will let you know what to do.
