  • cabot county court claim statue barred

    Hi newbie here. Have read a few threads and hope someone can help.
    my wife has recieved a claim from northampton county court from cabot financial for a debt with capital one which should now be statue barred. There is nothing on credit report either.

    I have done the acknowledge of service.
    do i have to do anything else on there as it has response forms i.e start defence, start part admission

    Also on the cpr
    "To enable me to file my defence and/or counterclaim, I require inspection of documents you mention in your statement of case ahead of filing my defence on*XX XXXX201X."

    Am i putting in a date where the xx's are

    Hi pe1007 & welcome.

    I'd just leave it at "ahead of filing my defense".

    Have you sent the CCA letter to Claimant (+£1 & proof of posting)?

        As i see on another thread should i send a letter to the solicitors mortimer clarke informing them that the debt is statue barred.

        Also on the cpr

          Have you paid into the account. or expressly acknowledged in it the 6 years prior to the court claim?

            Sorry didnt see that.
            for sb thought it had to be 6yrs. I know for fact that she has not paid anything or made any kind of contact for over 6yrs. The debt is also no longer on her credit report.

              Have you checked bank statements?

              Credit reports, while useful, may not be 100% reliable.

                No not checked bank statements. It was for a credit card 8 years ago and she defaulted 7 years ago. She has made no contact or made any payments

                              I'm not an expert, but from what I've read, if SB, the court can't give you a CCJ.
