    Keep checking the status of the claim with the court,.
    If Cabot don't have the info to enforce the claim may be stayed.

      Thank you for your help.
      I was going through all of my old paperwork yesterday & came across an old letter dated April 2009 from Shoosmiths, it was a reply to a letter I had sent them asking for details of every payment I had sent to them. The last payment was July 2008, I have made no payments since or acknowledged this debt.
      When the time comes should I go down the statute barred route?

          I meant once my 14 days extension is up on this claim!
          Also regarding statute barred would the last date be classed as my last payment in July 2008 or when I wrote to them in April of 2009 requesting payment history. If it's the latter then it's 6 years at the end of this month.

            If the letter did not amount to an unequivocal admission i.e. please send me a statement of MY payments to My account.
            If you referred to the alleged debt, or added I do not acknowledge this debt you're in the clear, enquiries/requests such as CCA requests are not admission of liability.
            Do you have a copy of the letter? If so post it here then we can give you an opinion on its status.

              Just re-read their letter & it was in response to an email I'd sent them, not a letter (that'll teach me not to scim read). In the email I ask for them to confirm the starting balance, balance now owed & payment history. I mention the car costing £4,000, the interest being another £4,000 (I was young & extremely stupid) & that I had paid off over £4,000 so would they be willing to reduce the debt as its all interest owed. I mention being willing to pay the debt (very stupid) but at a low rate due to having a low income.

              So going by that I last acknowledged the debt on the 28/4/2009, so it's not statute barred until the end of this month & is probably why they are pushing so hard for it now.

                I came home today (was away yesterday) to a letter from Shoosmiths stating that they haven't received the documents I requested from their client & that until they receive a response the matter will be put on hold.
                How do I proceed with the case now?

                  Check with the court regularly of any underhand action by Shoosmiiths.

                  No CCA = unenforceable!
