    I think the OP means the hearing on the application is to be hear 28/02/15, but it's no clear really.
    We also a have an application date in 2010 I see confused I am!!:tinysmile_cry_t:

      No Sorry my mistake I sent the paper work back on 28th January 2015 (last week) so still waiting on decision about Judgment being set aside but the application form 3623 which was sent by Cabot as my original Agreement as I have stated above what I want to know is how as Reston got granted default Judgment when all they have is the application form 3623 as evidence as my Original Agreement

        Hi Nem could you give me a answer to the question above as regards the form 3623 Application Certifcate no prescribe terms on it no number of repayments no dates of payments this cant be enforceable so how as Ristons been granted a CCJ thanks

          Because you didn't defend it they got judgement by DEFAULT.

                just on a separate sheet standard every day Ts & Cs what do you think of the Application Form Certificate 3623 have you come across this form before like I said every thing missing of it all the important bits to make it enforceable I don't think it is enforceable from what I have read

                  Hi Nem this is what Cabot sent me as requested as my Original Agreement and persist that this is enforceable and Ristons as you know have been granted a CCJ against me ok I get it now because I did not defend it but I cant defend what I never received

                    One wonders what an " application certificate" is actually supposed to be, " certifying you have applied" certifying the application has been accepted" ????
                    It has no T's & C's at all it seems.

                        The point is they have judgement and CAN enforce it as it has not been challenged,last post on this one if you don't go for set aside.

                          I have gone for set aside as I have mentioned above still waiting on results I am just trying to find out as my defence if the Judge would look at the above as being enforceable Original Agreement when there are no prescribed terms on that agreement I was on the understanding a Judge would kick that kind of Agreement out of Court thanks

                            Wait and see what happens with your application for set aside,post 53 clearly shows that they have supplied you with what they believe to be a credit agreement,unfortunately you didn't defend when you received this,if your lucky you might get a second chance.

                              Hello All need help I have to-day 14th Feb 2015 received a short letter from County Court Business Centre Notice of Transfer of Proceedings the letter says word for word
                              To all parties
                              This claim as been transferred to the County Court at ----------- for that Court to deal with the Defendant's application to set judgment aside
                              That Court will send you and the other parties notice of the time, date and place of hearing.
                              so my Question is have the court's accepted my application to allow me a hearing and a date as to arranged and listen to my defence or as it been sent to a local Court which as yet as to decide if I am allowed a hearing thanks
