              thanks streetwise for your reply I have sent to reston solicitor a cpr 31.14 request as Nem suggested is that any good or should I be doing something else to stop it

                I don't think you will get a reply from Restons re your C.P.R. request ,they have judgement, you need to go to the court and apply for the judgement to be set aside and if the Court grant your application then you can ask Restons for documents.

                  so if this went to court what about the fact that I have not had the chance to look at the debt and who the original lender was and the original agreement and it is again almost six years up on the 27th feb 2015 for s/barred

                    THEY HAVE JUDGEMENT,its been to Court,you never replied to the claim form.

                      The Stat bar 6 year clock stopped the day the claim was issued.
                      Make the App to set aside pay the fee and put your case to the judge.

                          APPLY TO THE COURT TO HAVE THE JUDGEMENT SET ASIDE,as you did not receive the claim form.

                              I have got the form from the courts N244 to have Judgment set aside what is the best way to build my defence do I simply say I never received the claim form and that's it or do I have to build a better case than that I don't even know what and who the original lender was think it must have been a credit card

                                Sorry for being a pain but still cant get my head round this problem just had a look at Noodle and my credit search shows that it was a credit card (only just joined Noodle by the way) it shows up that the account was opened in 09/06/2000 and a Default was put on the account in 27/02/2009 Cabot Financial then put another Default on the account 31/12/2014 can this be right 2 Defaults
