    Now one and the same company Cabot backed by an American bank acquired Marlin this year.
    Cabot is in the habit of " making up" its own " time scales" for statutory requirement e.g. 40 days for a CCA request.
    Cabot are debt purchasers now using Marlin as its DCA.

    Hmm, interesting! Cabot stated that the reason for the delay in sending out info under the CCA request was 'Your letter was addressed to Marlin Financial, however it has been passed to Cabot as we are the legal owner of the accounts'.

    In my humble opinion that leads a person to believe that they are two separate companies......

      In legal terms that are two separate legal entities.

      Regardless of the fact one owns the other, they are still two separate legal entities in the eyes of the law. So basically cabot own the debt, but marlin are chasing the debt on behalf of cabot, where cabot is simply marlins client. So it no different to a company employing a dca to chase debtors for payment of debts owed to the company employing the DCA.

      Any delay is irrelevant, as Marlins are still obliged to forward the request to the creditor and they still only have 12+2 days from the date the letter was posted to comply, and they do now have things called telephones and emails nowadays too. So if no CCA within 12+2 days they are in default of your request and can not enforce the debt in court, until they have sent you a valid and enforceable copy of the CCA, with all its terms and conditions attached and clearly readable.
