    That's one of the main purposes of sending the SAR. Cabot will have almost no documentation, so if you force their disclosure then all they can do is stall for time and ask the original creditor. They can't get from them what they don't have, so you need to know what they are still holding. The SAR allows 40 days for reply, but its likely that the claim will be dleayed anyway pending Cabot applying to the OC for the documents they need to supply.

      ok so can is there a link for the SaR or is that the 3rd step on amythest post. what happens about the court one I aknowledge that if I have to allow 40 days for SAR, sorry kafka for being rally thick just need to get it clear in my head what I have to do.

        The SAR timescale (40 days) means that you may not get that before your defence has to be in. Having said that, Cabot won't have any paperwork so will have to ask JDW for it. Normally they agree to an extension of the deadline for filing defence and hopefully your SAR will arrive in the meantime. Its not the end of the world if it doesn't, but it will help greatly to tell us exactly what documentation Cabot have access to. The important thing is to get these requests off (with fees where appropriate) asap. Let us know immediately you get responses and spend time reading up on relevant threads and how they unfold.

                  You can post the form back just saying that you intend to defend it all.
                  What is the date of issue on the form?

                  Send all the forms off in the morning by recorded/signed for, so you can track when they arrive and you have proof of receipt if they deny getting them.

                      You can add to that 5 days to get the Date of Service, which is the date the papers are deemed to have reached you. The 14 days counts from then and providing you acknowledge service you get 14 more beyond that. Theoretically you should file your defence within those 28 days, but if they can't supply your requested documents within their tight timeframe then you can ask them to agree a further 28 days to allow them to comply.

                      Hopefully they won't be able to get the papers and the delay will give us more chance of getting the SAR back. Ideally the statements will show that there have been no payments for at least 6 years, but the SAR will also give us other useful.

                        ok thanks kafka, so basically send all the letters off including claim form,and wait to see what arrives in the post. who do I ask for a further 28 days ? if needed.

                          The extra 14 days comes automatically when you acknowledge service.

                          That's the Claimant's solicitors if it looks like they can't comply with disclosure so you can't file a defence within the 28 days, but we're a long way from that. Just need to get all the letters sent and get reading other threads to understand how the process works and what can happen.

                              kafka I haven't got an account number or ref number to put on the top of the cca letter, do I just put the claim number off the claim form ?

                                Yes give them whatever ID they use on the court claim or letters they sent you before.
