  • Cabot stopped taking direct debit

    Hi

    I'm hoping for people's thoughts on this situation.

    I had a direct debit set up to Cabot which I have never cancelled and which still shows on my bank account, but which has not had money taken since March this year. I kept thinking 'it'll go out this month', but it just hasn't.

    I also have a standing order set up to Egg who are returning payments and have been for some time. Apex apparently took over the account and told me to pay them, but despite several letters from me asking both them and Egg for confirmation that I should now be paying Apex, this never arrived from either. I have at least 2 letters from Apex assuring me they are getting this information for me from Egg, but it did not materialise and instead I was getting up to two threatograms a week - this was when payments were still being taken by Egg, and carried on when the SO started to be refunded each month. The SO is still leaving my account each month and being returned.

    The thing is, I moved about 3 years ago and did not inform most creditors of the change of address. I had a redirect for two years, and apart from Apex's borderline harassment there was not much in the way of correspondence, and to be really honest, I was (and am now) still paying everyone and just didn't want the hassle.

    My question is, do I have a leg to stand on with regards to the payments if they find my new address? I can show that I have never stopped the d/d, and that I am still paying the SO each month. The dd must have been stopped by Cabot, I just can't think of any other explanation, and Apex, despite letters assuring me they'd send confirmation of their takeover of the account, never did this. I wrote to them many times stating that I wouldn't pay a third party without a shred of proof that they are the right people to be paying. From my position, with no word about it from Egg, an entirely new company wrote to me saying they owned the account and I should stop paying the OC and start paying them. Erm, no.

    So, do I write and give them the new address, try and talk to Cabot and deal again with Apex's constant letters, or do I leave well enough alone and sit it out? I've also not updated my details on Equifax etc. Actually I've just not used them for several years, so it's the old address by default. And my old name...

    I'm also thinking that I may well now have a CCJ (or two) in my name without even knowing. I have no interest in credit (no pun intended ) so this in itself doesn't worry me, and the house is in OH's name so no issues there. Are there any other problems with having a CCJ?

    Btw, the payments we're talking here are not big - both well under a tenner. Not sure if that makes a blind bit of difference, but thought I'd add it anyway.

    It would do no harm to check your credit file to see if any of the firms you mention have been playing silly buggers by placing defaults on the file or obtaining CCJs without your knowledge.

      The only thing is that I'd have to sign up again with experian/equifax as I cancelled them years ago, and this would mean adding in my new name and address which I'm really reluctant to do.

      Amusingly the one creditor I did tell of the address change (Lloyds, as they have my current account) have not bothered to change my details, so I've had nothing from them since the redirect finished either. You can't win can you?

        If the creditors and Lloyds are that incompetent and non-compliant with the law, let them hang themselves.
