It is important you make them prove absolutely everything and make sure they've dotted all the i's and crossed all the t's. Cabot are only a DCA, so unless it has been assigned in absolute, they have pretty much no power to demand anything.

Who is the original creditor? What was the debt for? etc..... If you can give us a fuller history, we can help you more.

      Hi Sweetcheeks,

There is so much muddled information in your thread, could I make a suggestion. Get a paper and pen and set out everything, exactly as it happened in date order, including ALL information on this thread and anything else which pops into your head while doing it. Once you are happy with what you have, please type it into here so we can see it all really clearly set out. We may actually be able to help you then.

      Thanks.

Also, in future, can I suggest you keep everything on one thread please, as starting separate ones for the same issue only serves to muddle things up.

OK - we've got everything onto one thread for you now. If you can do a chronological list of events, then that would be a help, what we're after is effectively a DIARY of what has happened when.

You should end up with ALL the information here set out as a set of dates, each on a new line, with what happened next to it. Things will be much clearer then.

No problem at all. Hopefully it won't be too big a task for you. :tinysmile_grin_t: It will help us try to make sense of things much more easily.

Re: Help with bank loan difficulties

Hi can anyone give me some advise pleeeeease????
ok, so I took a loan out with welcome finance about 6 yrs ago, I then got my PPI back in 2010 resulting in me having to resign paperwork. I still owe £8k and have been paying also never missing a payment. Today I checked my experian as we are trying to get a new mortgage and it says my welcome finance loan was satisfies/paid in full in 2010... I'm so confused????? There is nothing on my credit file under any name it literally says I am in no debt??????? Do I stop paying them? Honest opinions of what u would do please?????

Re: Help with bank loan difficulties

If I read this right the first mistake was the bank transferring the debt to your current account.
I suspect that when it shows your account closed they had moved it to another department (debt management)
Freds were then asked to collect and tried the strong arm tactic to get you to pay more which if the payments were up for review was within their rights but wrong IMHO
Then in 2013 the account was sold to Cabot who left freds collecting

Seems the bank know they did wrong I would be hoping for a refund of all charges , interest and credits you paid in along with interest. On top of that I would be wanting a sizable amount in compensation. Of course I want doesn't always get

Maybe Labman can help here .

Hi Jon 1965 Thanks for your reply. They've made a right pig's ear of this lot do you think. Spoke to the bank again yesterday and again they confirmed it was a loan and NOT an OVERDRAFT. And yes they said when it was moved to their collection dept it was all just put together for easiness Advised me to SAR them ASAP and tell Cabot there's a dispute. Thing is already done that but all I got was a threat.

Sure Labman will help....put it in writing and tell them exactly what is wrong, (Wait for Labman to confirm). I have a CCJ with barclays from years ago that was a loan and overdraft all rolled into one...if I knew then what I know now. Having said that they say they can not chase it as it is so very old
