    No, only ONE default can be recorded for each account. It makes no difference whether you made any payments into the account or not.

      ^ Thanks. I'm considering sending them a reply advising that I don't expect any further collection attempts from any third parties (I know they sell these accounts on to other internal/external parties), nor any erroneous reports to appear with CRAs.
      I assume I would report them to the FOS if they did? Also, is it best to wait until Barclays respond first? (They've got another 10 days before I report them to the ICO).

        I heard that an account that was ruled unenforceable in court was sold to Arrow the following year so yes, they do get sold regardless. If you get any letters from another debt purchaser, you can just respond attaching a copy of the letter you have to start with. If they still insist in pursuing you then a complaint would be in order but we are getting too far ahead now.

        The SAR is for your information only. If Cabot have written saying they're closing the account, I'd leave it at that for now with them and take it up with the ICO if Barclays do not respond in a timely manner. There's no need to inform Cabot of any of the contents of your SAR, it's your account, your data.

          Looks like Barclays are playing games. Today they returned my follow up letter with a note advising the info was sent two weeks ago by recorded delivery to my local branch. (Would they not have an internal mail system?) The manager there personally searched for it and said nothing was received and nobody from Knutsford had made any contact.
          The ICO said the two week deadline still stands and it's their view that the information could have been sent directly to me and is a red herring, and if I don't get the info within the deadline to start a complaint.

            Absolutely! All those companies have an internal mail system, besides, if it had been sent RECORDED, someone at the branch would have signed for it so they are definitely playing silly buggers.

            You need to complain to Barclays before you can escalate your complaint to the ICO.

              I spoke to the ICO today. They said as I'd already sent Barclays a 14 day reminder letter, to advise them that if they don't send the information to my home address within that period that I could start a complaint with them.

                Just to record that no information was sent by Barclays, but just as I was completing the ICO complaint form this morning I received yet another letter claiming it was sent to the branch. The ICO have advised that as I'd previously requested for it to be sent to my home address (twice) to give them 7 days notice before starting the complaint.
                They appear to be playing games for some reason, as they always respond to me on the final day of notice.

                  You can most certainly take Barclays out of the loop in this situation and make a complaint to FOS.

                      No you can make a complaint or seek advice from the ICO at anytime, advisors will give guidance in a phone call.

                          Hi FOS will expect you to have exhausted the full complaints process of the company (s) you want to complain about before you refer to them.

                          The ICO complaint can be made at any time.

                            Hi All,
                            I thought these idiots had been dealt with, but today I received another letter from them regarding the same account/amount, with a different reference number and a claim that the matter had been passed on to them. (From them!)
                            What's the best course of action here:
                            Refer them to their previous letter advising they wouldn't be pursuing it?
                            Make another CCA request to Cabot with the new reference number?
                            Start chasing Barclays again and make a CCA request to them (which I know they don't have after several months of chasing them last year for SAR information).
                            All of the above?

                                For reference: today I've sent Barclays a separate CCA Request after they failed to include it when I made my original online SAR request (I know I should have done this before, but I didn't expect to be dealing with this again)
                                A letter to Cabot copying my previous CCA request, my previous SB Notification and a copy of their letter confirming they were no longer pursuing the account as there was no credit agreement.
                                I've also asked them to comply with my original request if the agreement has now become available.
                                I know this is SB from my SAR info from Barclays, so hopefully they're just fishing.
