    Dammit, DavyB, if I EVER see a Wonga ad here, then I'm long gone. If I see one on A.N.Other's site, then I'll expect some "incoming...." !!!

      They replied to my email, gave me a reference number and basically said they can't discuss anything with me till I confirm who I am and tell them my contact details. Sent the following:

      Dear Mr XXX

      Reference : XXXXXXXXX

      Thank you for your recent correspondence.

      To allow us to provide further information and ensure we comply with the Data Protection Act 1988 before responding to your query via email we require that you confirm the following;
      Full Name
      Home Address & Postcode
      Date of Birth
      Please also confirm that you are happy for us to send potentially sensitive information to the email address supplied.
      Once we have received this information we will then be able to advise on any information required


      Won't be replying to that. They have no way of contacting me whatsoever. If they want to go through all the effort to track me down then they can do, I will just ignore them.

        For a long time now, DCAs send out letters to named individuals usually with the same or near initials, to try and get an alledged debtor/who they are not sure ofs address or whereabouts (people move - personal experiance decade a go), in the hope that an alledged debtor makes contact, the other one incorporated in some letters is if you contact us so that we can amend/update our details if you are not that person = or similair wording.


        Hence several people are told to wait and see if a DCA contacts them again.

        The letters do not normally state reason only that they are trying to contact a Mr/Mrs so & so, so they are not breaking OFT guidelines regarding disclosure of reason i.e. debt etc.

            I always prefer to leave the ball in their court, if possible. So - rather than ignore them, I issue an ultimatum. It's not technically/legally correct, but has stood me in good stead over the years. If ever it rears its head again, then it's on record that I responded, but it's also on record that the other party has effectively abandoned the pursuit - by ignoring ME. I usually try and email it, as I begrudge paying for a stamp. If you do have to snail-mail it, then get a Proof of Posting certificate from your local friendly Post Office - it's free.
            I acknowledge receipt of your recent letters, demanding money and threatening me with litigation.

            If I am to treat your demand with any seriousness at all, then I must insist that you arrange for the Original Creditor - allegedly and presumably XXXX - to DIRECTLY provide me with FULL details of this alleged debt, along with a proper Notice of Assignation of the same to yourselves.

            If you are indeed a legitimate DCA, then I am sure that you will be aware that this is not just a matter of common courtesy - but is a legal requirement. Until such time as you can supply clear proof that this alleged debt exists and is lawfully enforceable, AND that you have been lawfully and properly authorised to pursue it, then I would politely – but firmly - suggest that you refrain from threatening me with litigation.

            Should you attempt to pursue this matter through the courts, then please be aware that the court will require certain pre-action protocols to be observed. This includes viewing the conduct of all parties in the matter prior to the claim being submitted. I am not sure that the court would view the conduct of your client or yourselves thus far in a very favourable light.

            As things stand, I have no indication of what this sum of money is for, nor whether you have any lawful authority to request it from me. I am sure, therefore, that you will see that the only sensible action I can take is to treat your claim as fraudulent, which – incidentally – is why your original letter was treated with the contempt it appeared to deserve, and was simply ignored.

            I appreciate that you may well be doing a difficult job with the sincerest of intentions. However, I must ask you to similarly appreciate that there are a great many fraudulent operations in the field of Debt Recovery, and that I must - with all due respect - assume that your demand is fraudulent. Therefore, unless and until you can provide the lawfully-required documentation to support your claim WITHIN 14 DAYS of the date of this letter, it will be deemed by default that you have confirmed your abandonment of this pursuit.

            I am sorry to have to take this stance with you, but I have been defrauded before, and I am now very much the wiser for that. Please be advised that further unlawful attempts to obtain money from me will be referred to the Police as fraudulent.

            If you use this, then sign it with your left hand - or some other means that is NOT your usual signature. These creeps will often try forgery. If they try it with you, then you have an ace card.

                Indeed so, Puff. There are a load of great fonts for this that can be downloaded for free. I regularly use a favourite ("Signerica Fat 24") which is barely readable !!! Print it in dark blue, and it looks like you really signed your letter with a Parker fountain pen !!!

                    LOL - That's about it, in a nutshell I reckon !!!
                    But you should get an acknowledgement of receipt of the e-mail (send it out of office hours sometimes gets an auto-response) - or a Proof of Posting Certificate for snail-mail. Otherwise, they can claim they never received your request for the info.

                      I have been getting letters from this co regard to an old contract phone I had years ago that I had payed off. Just ignore these idiots, there's nothing they can do whatever you do, do NOT call them they will trick you into giving you the info they want, I made that very mistake, after that when they called I answered and told them they had the wrong no. then went and changed my no. if you do change your no. do NOT give it to anyone like finance/insurance companies get an e-mail account for them only, if its that important they can e-mail you!!

                        But now I have recieved today a second letter, from MacKenzie Hall, which to be honest has upset me greatly.

                        They have said that despite previous correspondences (I only have had the one letter) that I have failed to respond, and that they have now obtained this alternative address (??) as a financial link, linking this residence to the previous abode, and that they have been instructed by their client to recover an overdue account on their behalf. (I have lived at this address now for about 7 months, so have no idea how they could have gotten hold of me here).


                        The Pursuers are Cabot Financial (Europe) Limited, and the original creditor is Shop Direct group. The amount they are after is £300 odd


                        Letter also states that their clients have informed them (MacKenzie Hall) that they are unaware of any legitimate reason for non-payment of their account and although they would prefer an amicable settlement, they will not hesitate to take further action as maybe appropriate.

                        I have typed that as it appears on the letter, the parts worded in bold. I have until Noon 28th June 2012 to pay, and this printed in red pretty much frightened me (


                        What gets me is that right after that (and a printed signature from a Claire Thomson~MacKenzie Hall Ltd) is (again written in bold), and I will quote this:

                        Important: If you are not the named person above please contact us quoting Address ID: CMxxxxxxxx8 to stop any further communication.


                        Now the only debt that I know of would be from Kays catalogue a few years back. I did get into arrears, but thought that it had been paid off on 4th Feb 2008. I have no paperwork pertaining to this sadly, I have moved house twice since this and any paperwork I did have was lost in the moves. I did manage to find an old email that my husband had written to Kays, saying that he had sent payment of £235.32, and it had been sent recorded delivery. To my absolute best knowledge that was the amount we owed, not this £300 odd. I have no idea where that figure has come from.

                        I have not slept much at all since I had the first letter, and this is stressing me badly. We are in a very poor financial situation right now, struggling to keep our heads above water...and we have now gotten behind with utility bills/council tax. In fact I'm pretty scared about right now.

                        A problem for you may be that after you left that address, someone took out an order on your Kays catalogue for this amount. Request inform for MackHall on the last thing ordered, the amount and where it was delivered to. IF this is not yours what you should do is contact your local police for an ILN ref then give this to MackHall (if you cant get the ILN get the cops name and badge ref) - they will close the acct and send it back to the original creditor for a fraud inpection
