    Had a good read at the SAR, and the parts that i understood or should i say made sense is the area of' mydebt details. My name etc is detailed correctly, the section which stated default notice date, is blank on all four accounts. But the default date registered on my Equafax credit report is the same is the date provided by cabot.
    Also should their be deails of all payments made by myself, as the have only provided payments from 28/02.2011, even though i have been making payments from may 2010, in addition to a bulk payment of £3000.00 which is not detailed on my SAR
    The only correspondance from cabot applying for a ccj is a letter asking for my income etc, three weeks before the court date, which was held in Northampton, this is a long distance from my area.
    I have attended court (transfered to my local) 4 times as cabot have tried to apply charging order with out success.
    Reading through their witness statment i cant believe they have the nerve to wright such fiction, just glad i have all the correct evidence and details

      So what your saying is that they took you to court 4 times each to put a charging order on your property yet on each occasion they failed, yet according to the Data they sent you they have such charging orders in place?

      If so a complaint to the ICO is in order including details of missing dates and details on the generic documents - i.e. not copies of documents sent to you, but nothing but representations of what they claim to have sent with no prove of them actually being sent. Along with the fact they have not provided full disclosure of your account records with them in regards to all the payments you have made to them.

      I would also report them to FSA, OFT and Trading standards. Ohhh and a complaint to the court about their claim to have put the charging orders on to your property wouldn't go a miss either.

        Hi gillwall

        Can you put together a time line of events so we can get a clearer bigger picture of what has happened and when from when you opened the account to now

        in an easy to read format like

        xx/xx/xxxx open account with xxxxx for xxxx amount
        xx/xx/xxxx started missing payments
        xx/xx/xxxx they then stent this
        xx/xx/xxxx I sent that
        xx/xx/xxxx Ithey then sent this

        then also one for what you found on your CRA report

        what it shows and when

        As I suspect that Cabot has bought this debt from a OC (original creditor) and 9 times out of 10 proceedures are not followed correctly


        with regards to the CCJ

        how do you know they have obtained this? ?
        is it showing on your credit file??
        or have they just said that in the SAR? ?
        Did you discover this at court? ? ?
        why have they failed to get a charging order 4 times? ?
