  • Cabot/FIRE/MSDW

This is Morgan Stanley - Goldfish cc.
They have sent an illegible application form, all you can read are my OH's details. Over the last 4 years Cabot have sent at least 3 different sets of t&cs. The account has been put in dispute, which they deny.
This is with FIRE who have stated that at the time of entering an agreement with Goldfish the terms would have been legible. I am misinformed about my arguments and it is evident that I am delaying repayment of this account.
If I dont contact them they will escalate the collection process.

I would prefer to avoid another court battle with them so any suggestions as to my
next action would be gratefully received!
Should they be sending an annual statement?

Fire and Cabot share the same set of offices and are linked from what I found out.
had similar with a statute barred Citi account sent them both a "prove it" letter (template from here) and nothing back since November last year

Unfortunately this isn't statute barred, just old and illegible, which I'm sure won't stop them!

Try asking for "proof" this is what i did, if I knew this four years ago I would not be battling them about a Halifax one!

Fire and Cabot are both the same

As for MSDW I have no idea, new one on me.

At the rate Cabot are going this will likely end up SB'd anyway.

                      cymruambyth,

An illegible credit agreement, minus of the correct terms that were applicable at the point of execution.

Tell them to put up or, shut up!

Very naughty indeed to mislead a consumer...

That's what I tried last time and gained a CCJ?

                        Any suggestions gratefully received

I am presuming that the terms were varied?
You were provided with a second token/credit card?

Is this for the same debt as the CCJ was for, or have I got the wrong end of the stick?

Keep sending the prove it letters for now. Have they said where (or what) they are going to escalate it to?

Cabot, unearthed some MSDW agreements from some ancient coptic tomb or elsewhere...?
                              However, the $64,000 question is:
Which terms go with which illegible microfiche agreement?

                              Cabot are chancers!
