    Nifty input AC - thanks. I have always been unsure about the 'Without Prejudice' header. Whenever I get one, I instantly suspect that the other party has stuff to hide - and thus is guilty of something. BUT - I believe that the originator ('author') of a 'Without Prejudice' letter retains the option to change its' status to 'Within Judice' if they so wish. Basically, they retain the right to 'spill the beans' if they so desire.

    But I am mightily impressed by the clever wording you suggest, and that is worth its' weight in gold, IMHO. It seems to carry weight. Clout - even.

    Pedantics, now, but the DSAR has often been reduced to 'SAR.' My understanding of the term 'Data Subject' is as you have stated. The DSAR - 'Data Subject Access Request' is then a Request - by the Data Subject - for Access to the Data that is held by the Data Controller on that particular Data Subject.

    I have to admit that I do prefer the DSIR mnemonic, though - it seems to make more sense. But the currency here is cold hard Data - not Information. Having said that - I need to Google the difference 'twixt the two !!!

      Some firms refer to a request under section 7 of the DPA, as a Subject Access Request (SAR).

      Other firms e.g. Egg refer to a DSIR:

      The term SAR, would appear to be more current.

        Hi Bill regarding the SAR they are in breach now four years on the SAR! They cashed a cheque 30 March 2007!!! Still have the bank statements and cheque no as proof, my siganture was on the cheque! Do not see why he should pay £10 again.

            Okay I have decided to still go down the route of claiming Compound interest on the claims as per Sempra Metals

            I am reducing the claim to the applied interest rate at the time being 14.9 % (so quite a lot lower but fair)

            Bill could I ask if the spreadies could be sent as I think I accidentally deleted some messages I am so grateful for your help here

            Here is a letter I posted the other day which is a reply to the Charges/Letter before Action. I have changed it to take into account the Sempra Case and extra concerning the £12 charge they feel is fair and arguments against.

            Please take a look. I would like to get this off asap to Citicard.

            By the way received a letter yesterday from Cabot returning the £1 fee, however saying they will contact lender for CCA.

                Nice reference to Sempra, BTW, but I hope someone more learnéd than I can check your letter. AC maybe ?

                    hi milly, had a quick look at the letter and it should do the job you are looking for, not sure how well the Sempra reference would hold up if scruitinised as the 8% simple rate for statutory interest is laid down in statute (s.69 country courts act 1984) however it shows your not afraid to do your homework and play them at their own game so is still usefull to include.

                    I'd go with that and see what they come back with.

                    Hope you get the result your after...
