    hi people new here so please be gentle !!!!

    a few years ago I did the naughty and ran up a credit card and then simply moved. I know its my debt fair enough.. card had 250 limit and at time I was out of work and going through a major depression... (lost my brother)

    anyways a few months back (21-10) to be precise I find a letter from Mackenzie on my doorstep relating to this debt with Citibank and as I knew I had ran the debt I discussed it with them and they agreed if I paid half the outstanding amount (441) they would accept that and CLOSE the account.
    I didn't have the money but upped my overdraft and cleared it fearful of getting grief recorded against me on the credit reference agencies as for a long time ive been a good boy, all things paid on time we have no cards of any description and just a single bank loan..

    got home from work today and on the doormat was another letter...

    "BROKEN ARRANGEMENT - DEFAULT FIELD VISIT"

    Do I have a leg to stand on as the agreement with Mackenzie was done verbally over the phone and to be honest I cant even remember who I spoke to.

    Im worried sick by this, I have just got through christmas, my partner has been made redundant through the business she works for going under (2 months wages owed) and there is no way on gods earth I can find another £441. And seeing as I had agreement that I had closed the account why should I anyways???

    I will add. AT NO POINT was any form of arrangement made to make any further payments as as far as I was concerned my settlement deal had been done and this was all done and dusted.

    Serious IGNORE anything Mucky Hall have to say as they specialise in the unrecoverable.
    99.9% of what their letters say is make believe.

    Have a read of the first link in my siggie and Don't Panic as that is what they rely on.

      ill be honest its got me on edge big time.. I have Aspergers syndrome and the thought of someone angry on my doorstep is enough to have me having panic attacks... my hearts going 10 to the dozen here

        thing is I acknowledged the debt was mine.. because it was.. and you can bet they have that on recorded phone call... bet you dime to a dozen the verbal agreement to end the account is missing though

          Seriously DON'T sweat it.
          It was most likely barred by the time Mucky hall got their hands on it.
          When was the last acknowledgement before Mucky Hall ?

              i do trust him, I came here on good advice, before novembers incident there had been NOTHING in relation to this debt..

              theyve already had £441.48 can I get this back lol

                  Absolutely listen to Curly Ben. The whole construction of the communications from MH is designed to make you worry and put you on the back foot. That way they keep you on anxieties doorstep and you are less able to think straight. I have listened to Curly Ben and followed his advice and I trust him. I sleep at night too. Good luck.

                    TBH extremely tricky.
                    While the debt may well be statute barred this only precludes legal action.
                    It does not mean the debt simply ceases to be or is voided.

                    Either way if the original limit was £250, then the payment made more than covers any out standing indebtedness.

                    You could try reclaiming the charges directly from the Original Creditor, but they well put up a fight due to the age.

                        be interesting if someone did try an get into my house though.. 1 great dane, 1 greyhound, 2 hairy lurchers an 2 smooth lurchers may have something to say about it...
