    yes the same for the so called "deed of assignment" from Citi,
    all sent off by 2nd class (could not quite manage 1st class) also send them recorded delivery.
    This is getting almost as much "fun" as Welcome Finance!
    Still nothing from Cabot, surely they have had the " alloted " time by now?

      Well, cAbot seem to know what they are doing....


      After sending the letter stating that account was in dispute because of not provding the CCA... Received letter today and they have returned the £1 yet again...

      I'm tired now. They have said that the account is on hold and that they are stil trying to obtain the CCA fro Citi. I'm tired of fighting, so have paid the £1 as the interest has been frozen.

      I'm just going to keep looking for work and save up to pay them off, can't do any better than that.

        Still no reply from them so far... posted the ccas again can any one else tell myself and Tya tell us why Cabot chose to send back the £1 is it because they cannot provide the documents requested and do they REALLY contact Citi or are they just saying they are?
        Not paid anything on this one yet as I have had the argument that if you pay you "admit" that it exists and so far they have not proved that they have the right to claim off me

          The account has been in dispute with Citi since 2005, and in fact is now 'statue barred' since May 2010 (I'm in Scotland) so I await with pleasure them contacting me

          I also have two other accounts with Cabot (can't remember who the O/Cs are) which have also been in dispute for 4 years as Cabot haven't been able to get the O/Cs to produce CCAs. I haven't heard anything from Cabot for a couple of years in respect of these other debts. All I had was the letters stating they are trying to locate the agreements. Don't think they will somehow

            We also have two more with Cabot both Bank of Scotlands group with both they have failed to supply ccas but still been making token paymnets to these should I stop?
            One is now with the financial ombudsman due to failure to comply from both Cabot and BOS they other in the early stages.
            How long are they suppoosed to take?
            Last letter frm them saying they were still "looking" for the Citi ccas was October 18th

              Got the standard reply from Cabot along with the £1 still do not know why they chose to send it back keeping it along with documents I have already!

                Same here have got letters ready to send got to get the postal orders (Cabot usually send them back from other posts!) but sending it anway am going to cancel standing order today and go from there!:tinysmile_kiss_t4:
                How do I "bump" this to its "own" thread I have some more questions regarding it and it seems unfair to join it to someone elses

                  Got letter from Halifax, sorry have not quite worked out how to scan and copy to the forum yet!
                  They say;;;;
                  "You have requested under section 77(1) of the Consumer Credit Act 1974 (the Act) a copy of the above loan agreement.
                  Subsection 77(3) of the Act provides amongst other things that section 77(1) does not apply to an agreement under which no sum is, or will or may become, payable by the debtor.
                  The above loan was re payed on 21/07/06 this means no sum is, or will or may become payable by the debtor and therefore the bank is under no requirement to provide a copy of the agreement any document referred to it or a statement of account."
                  What do you think.... are Cabot in the old brown stuff and should I send them a copy of this and a request for refund of any money sent to them?

                          Hi Dogtired,

                          I got a letter from Citi re my SAR & CCA.. They have said that they do not have this info as my account has been sold to Cabot and that I should contact Cabot for these things... What the hell is that all about??? ( of course returned PO's)

                          Then I get another letter from Citi stating that for me to have the info requested, I need to send them a PO for £10? So what does that say? Are they playing games with me?

                          I haven't bothered to SAR Citi again, I'm tired of all this recorded post which really does add up when you have a lack of finance.

                            Another letter on the lines "we are waiting from Citi "with different amount on it, made enquires of the regulator who says just wait for the response another 21 days apparently, how do they get away with it.
                            Its getting beyond a joke will have to think about SAR Citi but money short st the moment, meanwhile doing what i can to find out if I can get this sent back to Citi on the grounds they should not have "sold" it twice.

                                I received another letter from Cabot last week stating that "unfortunately Cabot has not been able to provide you with the requested information within the relevant time period" They say they will continue to request the info from Citi and my account is on hold...

                                Think I will just let it run as it is, my balance has increased over £500 in the few months that these guys have been messing around! Checked back through old files and my card was originally Peoples so I would think the chances of an original agreement being found are slim....I hope!!
