        Thanks Wendy & Tuttsi. All the best for the New Year to both of you too.
        No response at all from Cabot. County Court is shut down today due
        to adverse weather condition and notice in window advising all
        hearing adjourned and will be notified of change date in due course.

        That's another day off wasted for me. I only have a few more years
        to retirement myself. We were so looking forward to resolving our
        problem today, and it's a bit of disappointment.

          Never mind Kelsey, you never know, the delay might turn out to be a blessing in disguise, it will give Cabot more time to think and reply to you, won't it? You may still yet get it sorted withouta court appearance. Have they replied to your letter yet?

              It is a pity that the courts were closed yesterday.

              Lets hope that it will give you more time to get that payout from Cabot/Morgan and this way you have time to negotiate with them.

                Hello everyone,

                Just been to Court to enquire new hearing date. Hasn't been set out yet due
                to skeleton staff/bad weather condition. As per today's records, no rebuttal
                reply from Cabot/Morgan - due in Dec. 31, 2009, by 4p.m. So they are now
                in default to the court's order. No reply to our request for offer either.

                Will keep you all informed.

                  See what they do now about your claim against them to prevent having to appear in court.

                      Well I would think that its in their interests to make a deal with you over your damages than risk you asking the court to judge this.

                        thanks Kafka. We are hoping to hear from them too. Our last request to the Court
                        was for the court to impose damages to the maximum allowed by law, plus costs.
                        We thought that would have encouraged them to respond directly to us. But let's
                        see what happens. We'll keep you posted.

                            hi Everyone,

                            Just been back from County Court. Good news - the Northampton Court
                            judgment has been set outside. Likewise, the interim order on our home
                            has been discharged.

                            We were not awarded any costs. The judge requested that we submit a
                            proper legal defense prior to the new hearing date yet to be decided,
                            with a warning that we could lose if it goes to trial. But an unsatisfactory
                            judgment for Cabot when he slated their latest submission as evidence.
                            It contained nothing more than blanked out pages supposedly emanating
                            from the original creditor, and in fact was generated by Cabot's International
                            Office.

                            We could do with some asdvise now on how to proceed, and provide the
                            court with the necessary defense claim.
