      Re: Cabot/Morgan

Kelsey that's a good start. You've obviously got an admin background! I would be inclined to expand a bit on the compensatory damages, something along the lines of

your continued actions and harassment of me/myself and my husband in respect of a debt to which I believe you hold no legal title, and which culminated in the Judgement against me in Northampton County Court, have caused unneccessary stress which has had a detrimental impact on the health of both myself and my husband. (You could expand a bit here if you like, but keep it businesslike and professional).

Also add in that you wil be submitting a copy of this letter to the court.

and don't end it very sincerely yours - that would make it look like you like them lol. Yours faithfully will suffice.

Next draft, just copy and paste it into the thread so we can edit/add bits in.

Pasting in the thread is much easier.

Also, you don't need OCR software to scan a letter unless you want to edit the contents. here, you just need to scan a letter as a jpeg image.

          Dear Wendy,

Please read below the amended draft-letter we intend to post to Cabot in the morning.
          Any input/amendments will be appreciated.

          Thank you.

          Dear Sir/Madam

          Ref : Claim No xXXxxxxx

Further to your letter of the 22nd December 2009, we find the proposal
on the second paragraph regarding each party responsible for its own
          costs unacceptable.

Please note our revised costs/expenses attached, which will be submitted
to the Mansfield County Court together with a copy of this letter.

In addition to these costs/expenses, we would like to invite your proposal for
          compensatory damages.

In particular the effect of your continued actions and harassment of myself and
my husband, in respect of a debt which I believe you hold no legal title and which
culminated in the judgment against me in the Northampton County Court. This had
caused unnecessary stress and had a detrimental impact on the health of both myself
and my husband. My husband has been struggling for the last 12 years with a serious
illness and had recently undergone major surgeries.

Time is of the essence and we are looking forward to your response and offer.

          Thank you.

          Yours faithfully,

            Kelsy

See if there is anything in this that you want to use.
Trying here to get them to agree a decent figure by letting them off the hook regarding publicity and formal complaint. I don't like doing this, but its worth a shot if it can get you a decent return, but that's your choice to make.

            Dear Sir/Madam

            Ref : Claim No xXXxxxxx

Further to your letter of the 22nd December 2009, we find your proposal unacceptable regarding each party being responsible for its own costs. Please note our revised costs/expenses sheet - which is attached - and this will be submitted to the Mansfield County Court together with a copy of this letter.

In addition to these costs/expenses, we invite your proposal for suitable compensatory damages, in respect of a debt to which I believe you hold no legal title, despite the fact that you obtained a CCJ against me. This action took place during a period when my husband was suffering from extreme ill health, after struggling for the last 12 years with a serious illness and having recently undergone major surgeries. In particular, the effect of your continued actions and harassment has caused unnecessary stress for us both and had a detrimental impact on our health.

As you held no legal right to pursue this account, I hold your organisation fully responsible for the consequences of your actions as described above. Unless a satisfactory settlement is reached regarding damages, I will request the court to award substantial damages by detailing the full circumstances of the effects of your actions. I will also reserve the right to publicise the case in any way that I see fit and to report your actions to the relevant authorities, recommending that they question your fitness to hold a consumer credit licence.

I am sure that I do not need to remind you of the gravity of your situation. Time is now of the essence and we are looking forward to your response and offer.

              Kafka,

Thank you very much indeed! We are holding our breaths here, awaiting some
response to our last posting, as we need to send this letter first post tomorrow,
copies submitted to Mansfield County Court.

We shall be finalising our letter response before we retire tonight, just in case
there are additions/postings that may be useful.

Sorry I haven't been around much this afternoon (blame a broken washing machine and a day trip mto the bagwash lol) Anyway, your letter looks great, I can think of nothing further to add especially now Kafka has added his input too. Let us know as soon as they reply. And don't forget to send it Recorded Delivery so you have proof of them receiving it.

Well my letters to DCAs are never subtle.
I just hope they realise that they are on a hiding to nothing here if they try to tough it out until the hearing, but they are so thick skinned.

Wendy, Tuttsi & Kafka, and everyone -

Thank you again. My husband is just getting ready, first to his docs for some prescriptions,
then to post office for that recorded delivery post to Morgan's solicitors, then to Mansfield
County Court for their copies, and he is calling at McDonald's to read papers whilst sipping
piping hot black coffee and perhaps with sausage/egg muffin for breakfast. I'm just ready to
drive to work myself. I'm in HR for a local gov't authority. Fingers crossed this nightmare will
soon end, and looking forward to a Cabot-free life in 2010!

Thanks. That's brilliant! I haven't thought of sending through fax as well.
I'm switching on fax machine now, and hoping they will get the message
before they break for New Year's.

Well if they do respond positively you can hopefully get some recompense for this, as well as getting the CCJ removed. Is there an issue with wrongful default as well as this is not clear? You need to be certain that there is no default registered anywhere. the absence of a valid default process is further support for the setaside, should you need this, although that's unlikely.

If they don't respond then you will need to go the hearing fully prepared with all the data, arguments and demands.

You've been extremely helpful. And yes, we are prepared with all the documents
for the 6th Jan hearing. Sorry to have responded late, just been back from hospital.
I have to take my husband to the emergency dept. Been a long day for him running
around this morning with those postings, and the new medication have made him ill
                                the whole day.

Many thanks again to you and everyone.
