    Hi,

    Getting loads and loads of phone calls from this pain in the ass company so I emailed them the following:

    Dear Sirs

    Harassment by telephone


    Account Number: UNKNOWN

    I am emailing in relation to the quantity and frequency of telephone calls
    that I have received from your company, which I deem to be personally
    harassing, the telephone number concerned is xxxxx xxxxxx.

    I now require all further correspondence from your company to be made
    strictly in writing only.

    I am of the view that your continued harassment by telephone puts you in
    breach of Section 40 of the Administration of Justice Act 1970, and the
    Protection from Harassment Act 1997.

    If you continue to harass by telephone, you will also be in breach of the
    Communications Act (2003) s.127 and you will be report to OFCOM, Trading
    Standards and The Office of Fair Trading, meaning that you will be liable to
    a substantial fine.

    Be advised that any further telephone calls from your company on the above
    number will be recorded as evidence.

    Furthermore, make note that I do not acknowledge any debt to your company.

    They wrote to me today with the following letter along with a Ombudsman leaflet:

    The harassment act has been amended to exclude consumer complaints. You can demand under the DPA that they remove ur number from their records and as you have done ask for everything in writing.

    Tell them you are going to report them to trading standards undue pressure/harassment is an a breach of OFT debt management guidance and the Consumer Protection from Unfair Trading Regulations 2008. Remind them that as they have a credit license they should know better.

          I have formally requested that these stop, but I am still receiving calls. (Delete if necessary). As is my right under the DPA I require all further correspondence from your company to be made in writing only.

          I am of the view that your continued harassment of me by telephone puts you in breach s 2,6a OFT guidance 664 - contacting debtors at unreasonable times and at unreasonable intervals and also CUPTR 2008 - 7.11 - Failure to adhere to a code of conduct - to hold a credit license you signed up to be bound by OFT guidance.

          If you continue to harass me by telephone, you will also be in breach of the Communications Act (2003) s.127 and I will report you to OFCOM, Trading Standards and The Office of Fair Trading, meaning that you will be liable to a substantial fine.

          Be advised that any further telephone calls from your company will be recorded. (**Even if you don‘t yet have recording equipment!!**)

            I therefore again formally requested that these stop immediately and no further communication from yourselves via telephone now or in the future, as is my right under the DPA I require all further correspondence from your company to be made in writing only.

            I’m of the view that your continued harassment by telephone puts you in breach s 2,6a OFT guidance 664 - contacting debtors at unreasonable times 21:55PM most evenings and at unreasonable intervals, up to 10 times a day and also CUPTR 2008 - 7.11 - Failure to adhere to a code of conduct - to hold a credit license you signed up to be bound by OFT guidance.

            If you continue to harass myself via telephone from this email, you will be in breach of the Communications Act (2003) s.127 and I will report you to OFCOM, Trading Standards and The Office of Fair Trading with all written and recorded evidence, meaning that you will be liable to a substantial fine.

            Be advised that any further telephone calls from your company will be recorded via "Trucall" that’s in place.

              Try the following amendment in the middle bit

              I therefore again formally requested that these stop immediately and no further communication from yourselves via telephone is received, now or in the future. As is my right under the DPA I require that you remove my telephone number from all your systems and ensure that all further correspondence from your company is made, only, in writing .
