      Also can you just clarify something for me please.

      I have seen some examples of letters on here from Cabot claiming that an application form is sufficient as it is headed with "Consumer Credit Agreement Regulated by the Consumer Credit Act 1974"
      It also contains a box giving examples of interest rates in APR for several different amounts of credit (starting at about 38% for 100 credit limit up to around 66% for 1000 credit limit.)
      It also has what is alleged to be my signature.

      Am I correct in the belief that it has to contain a the signature of the Creditor also in order to be properly executed? This does not.

      The enclosed letter from the OC is dated May 2009. It claims that they have adhered to my statutory request and have enclosed.... "the executed agreement in the form of 1) Terms and conditions, 2) Application Card."

      I believe the OC sent Cabot those items in May and they are perfectly aware that it is not a properly executed agreement. I believe they have dragged their heels this long hoping to obtain something more. Then when they couldn't, they have decided to forward what they do have and hope it will convince me that they have a case? Would you agree?

          The mere fact of the example APR's is failing enough under CCA, after all you have NO idea what your actual limit is..
          Yes the agreement does have to be signed by the creditor to be properly executed.
