    One word - Securitisation !!

Bit of double bubble for the OC's. They claim the debt as bad and get tax relief from it as well as cash from the DCA to boot.

      Re: Cabot CCA response

Its a win win situation for the OC then! With regard to your footnote, by what process would you have a debt returned to the OC? Wouldn't they wash their hands of it especially having received the money from the DCA and he tax breaks?

        That's their choice really.
What they attempt to do with it is up to them.

                    Re: Cabot CCA response

Hi everyone. Its been a while but we have just received a letter from Cabot claiming that they have provided the information requested and are now allowed to resume collection of the alleged debt.
However, all they have sent is a very poor, barely legible photocopy of an application form which allegedly contains my signature. However, the signature matches the fake signature I applied to their "prove it" letter and is suspiciously small for the size of the signature box! I am almost sure I have not done my signature like this in the past and deliberately did it slightly differently so that I would know if they copy and paste it!

Also enclosed are 6 seperate pages of A4 entitled "Vanquis Credit Card Terms And Conditions." In a box at the top it says "This is a copy of your agreement to keep. It includes notice of your cancellation rights which you should read"

It then says "Consumer Credit agreement Regulated by the Consumer Credit Act 1974.

It could be anybody's agreement! It bears no reference to page numbers or sections or subsections. It is merely a leaflet photocopied. There is a strange date and time reference at the top of PAGE 1 being the second page of A4 and PAGE 2 being the 5th Page of A4.
It bears no name, address or signature either. It looks basically like a copy of a booklet.

Am I correct in the belief that an agreement must contain a signature of both parties and all T&C's referenced must be within the 4 corners of the document or at the very least reference made to sections or indeed page numbers???
I am sorry I am a little rusty as they have only just produced this.

There are a load of copy statements for the account obviously forwarded by Vanquis.

Please can you indicate which letter I should respond with.

                    Thanks
                    Redletter.

Hi Curlyben! Great to hear from you. I did wonder if you were still around.

Forgive me I am a bit rusty. When I got the Cabot letter I had butterflies, a mixture of anger and nerves!

What is the I and 0 or am I being thick?
                        ------------------------------- merged -------------------------------
I dont want to get into playground quarreling with them but do I need to respond and tell them they have not complied?
Should I point out that this is not an agreement but merely an application form and random terms and conditions?
Please remind me where to find the letters.
Sorry I guess you do a lot of baby sitting on here I'll be ok once back up to speed.
I appreciate your swift reply also!

                                Thanks for the above Curlyben.
I have not responded to the letter in any way.
Yesterday I had a voicemail from:0800 9172225 asking me to contact them regarding "a private business matter" I googled the number and found it to be a Cabot number.

Should I now respond to the letter and also tell them not to call or should I just keep ignoring them?

                                Thanks.
