  • Cabot - quick question please

    Cabot have told me that my debt to them is currently unenforceable - the credit card was taken out almost 30 years ago and the credit agreement can’t be found.

    I’ve never paid anything direct to Cabot, but I did make £1 token monthly payments to Wescot when they were collecting on Cabot’s behalf, before the account was passed back to Cabot.

    However, even though Cabot state the debt is currently unenforceable they keep reminding me that payments I have already made towards the debt (to Wescot) is evidence that the debt is mine.

    My question is : do I have anything to be worried about here due to these past payments, or am I covered by the fact there is no CCA and Cabot stating that it’s currently unenforceable?

    I suggest that you write to say that you will entertain no further communication regarding a debt which they acknowledge is statute barred and unenforceable.

      Although Cabot told me it’s unenforceable it’s actually not statute barred unfortunately, if that makes a difference!
