    Hi,
    I am wondering if anyone can help.

    I have been paying a low amount each month to Cabot after they bought the original MBNA credit card debt. It’s was originally taken out about 10 years ago.

    I sent off the CCA request and their response came after 12 days saying they are contacting the original creditor and will send me the documents but until that time they can’t take action ( or something to that effect)

    I am wondering if anyone has had similar and if they did find the paperwork?

    it’s just because I also requested a cca on a loan and they came back saying they don’t have paperwork so unenforceable. I’ve just still pay them minimal … not sure if I need to stop paying now ?

    im just worried the MBNA won’t be the case , never been in debt since , it was a very bad time back then when I was dealing with the loss of my partner.

    Welcome to LB

    If the loan debt is 'unenforceable', you should stop paying until they can produce the documentation.

    Give them 4 weeks, then send a CCA chase letter. See what their response is. It's 'unenforceable' until they fulfill your CCA request.

        I really couldn't say, best to wait and see. Whatever they send needs to be compliant.

          Hello. It’s been about 9 months till my reply from the CCA letter came back saying they can’t provide the original paperwork. Do I stop paying the small amounts each month? Will doing this make them more likely to try and find the paperwork? Or is the fact it’s been years and years mean they’re less likely to provide it ?
          I am unsure what to do .

            They either have it or not.

            They may find it difficult if it's been many, many years that has passed.
