    OK right then.
    Yes get the CCA sent, ALSO make a request under CPR 31.16 as detailed here: DCA: Using CPR 31.14 to Your Advantage - Consumer Wiki

    Once they ignore both of these we can work on a defence, I have a nice new one for N'hampton actions, especially when you are for clarification

      I assume this is the POC as stated on the N1 ?
      Is the account number recognised or simply a Cabot reference ?
      Is this action being taken in Cabot's name ?

      Seems they have been playing fast and loose with the interest there as well, adding about 1k to the defaulted balance.

        the number refered to in paticulars of claim is a cabots reference number

        yes action is being taken in cabots name

            i have sent the two letters to cabots, though i have acknowledged the claim do i send copys of the letters to the court . what bdo i do about defense

              Make sure you have copies of the letters sent, but there's no need to send copies to the court.

              As for the defence, we'll file this online a little closer to the date, gives Cabot a chance to respond to your requests
              We'll file on the 9th or 10th.

                  well things are on the move i have had a letter from cabot financial dated 4 march 2009. reads as follows.

                  dear mr crane.

                  your request for information under the consumer credit act.

                  we acknowledge reciept of your request uder section77and/or 78 of the consumer credit act 1974.

                  the cabot financial group is not obliged to provide this information but we are pleased to help and have already requested the documentation for you from the original lender

                  what happens next.

                  we anticipate that we will be able to provide this information within 12 days. in the evevnt
                  we are unlikely to obtain this information within those time limits we will write to you again.

                  contacting cabot

                  if you have any queries about your account or any payment options call one of our helpful customer advisors on 01732 524616 (minicom 01732 524615)

                  in the meantime we thank you for your co-operation

                  customer relations department

                  probably the standard reply but i am not sure any help gladly recieved

                      no response to the cpr letter nor to the information disclosure letter.

                      whats my next plan because i will have to file a defense around the 9th march and may need some guidence to do this
