That's an application form = not a CCA agreement. Cabot's can't enforce an application form at all.
Read my thread - my hubby is in process of taking them through court for this kind of stuff. They can't enforce the debt due to lack of papers and they had tried to do this and were struck out of court through having no papers etc.. when they tried take hubby to court. Judge did order paperwork again in this case and they never showed it.
We asked Cabots to stop writing to CRA's and they refused saying they aren't chasing debt BUT are going to continue writing to CRA's and will add interest at 12% and default will stay (they are having a laugh???)
We wasn't having that so issued a claim against them - if anyone here wants my POC's and how we did it etc.. PM me your email addt I can email a copy of the claim form used etc.. to you.
Judge has ordered them to show ORIGINAL CCA and given them 8 weeks to do so - else they'll be in heap big bothers!! Their time is running out "tick tock" we are about to notify Court we need another hearing date as they've not complied again!! :carrot: :roll:

Acknowledge Claim - within 14 days from Service
Defend Claim - within 28 days from Service (IF you acknowledged in time)
If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
