  • Mortimer Clarke claim form

    Good Morning. Was wondering if I could get some help. in 2005 I took out a loan with black horse finance. I have now received a claim form from Mortimer Clarke solicitors. They originally were working with cabot who had bought the debt from Marlin I think they were called. However, the claim form now has ME IV Limited as the claimant. I have acknowledged the claim which I would like to defend in full. Hope someone can help.

    Really sorry to read Ally. They are all actually the same company with the same directors. Marlin Europe has various lettters after its name and has changed names for tax purposes and create difficulty with accountability of subsidary companies.*Cabot will also change its name soon.

    Read and follow the instrctions in the sticky notes and top right hand box when you see this page in a webpage. Essentially make photocopies, draftout what you could write in word.Make SAR to all companies.Make CCA requests,Make CPR 3.14 requests -see guide and buy a £1 postal order. When I did this, i sent them all in the same envelope a week after receiving teh claim form but then had to redo this and re-send with signed delivery to show in court if needed. (learn from my mistake)

    I have no legal experience and was in the same position as you. There is hope. Other forum members will post, please be patient but do not wait, start reading

      Acknowledge Claim - within 14 days from Service

      Defend Claim - within 28 days from Service (IF you acknowledged in time)

      If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
