  • Help ASAP Cabot Financial/ Process/N61- ordered to report to court 22/05/19

    Sorry for short notice but the letter was received on 16/05/2019. This is my first post on here, I need some help. I have received this letter about attending court for a N61 form. I have no idea what the debt is or when from. I have attached an image of letter but due to size this is all i can fit into image. The letter is from HM Courts & Tribunals Service (Bailiffs office Liverpool county court.)
    Claimants; Cabot financial.

    Should I attend?
    What am i expecting?
    some of many questions i need answering.

    Yes, you should attend.

    If you refuse the Courts order things could become a lot more problematic for you!!

    Were you aware of a CCJ that has been entered against you by Cabot?

      Thanks for the reply, I received a letter from Northampton county court, to be honest had no idea and just left it an advised to ignore, obviously not good advise. what am i to expect or how should I prepare?

        Well it seems you have been sued, lost, had judgment entered, refused to pay or at least thats how the Claimant sees it, and therefore you have been ordered to attend Court for questioning about your finances. Ignoring Court papers never ends well sadly.

        Can you tell us more about the Court letter, what did it say? who told you to ignore it?

          Was a friend who said has had a lot of hem and nothing ever came back so took his advice.
          Northampton Court letter was binned, all I can remember I think was attachment of earnings, which I thought Cabot or Mortimer solicitors was trying it on. In my credit file it states that the alleged debt with these guys was opened 22/11/2013. I do not know what debt is actually for or original creditor. Most recent court letter reads as follows;

          Claimant: CABOT FINANCIAL LTD

          Case:********

          You are ordered to report to the Court Office on : 22/5/19

          Between the hours of 09.30am - 11.00am to receive: - PROCESS/N61

          Failure to do so and may result in you being committed to H.M. Prison for contempt of Court.

          PLEASE BRING THIS LETTER WITH YOU.

          then has bailiff contact details at the bottom.


          Can I ask for proof of debt and can he debt be legally sold on with out my permission.
          Would it make any difference if the claimant had no copy of original contract.

          As I have no idea what debt is or original creditor.

            Its a bit late now to look at fighting this in my view. I fear you had the chance to fight but chose to ignore it. i dont think there is a lot you can do now.

                    I spoke to a solicitor and had them speak to bailiffs office at liverpool family court, still in process now but dont look good. I think a payment plan will have to be agreed.
