  • Nolan’s solicitors served writ on behalf of Cabot

    I have been served with a copy writ and warrant by Nolan’s solicitors on behalf of Cabot Financial Uk Ltd in relation to a Lloyds TSB Loan. It says I can either admit the claim and apply for a time to pay direction or time order, or I can defend the action. I really don’t know where to start or what to do. The dates within the documents referring to an action raised at the sheriff court in April 2018 have been scored out and amended by pen (date of service and date of expiry of period of notice) and changed to July and August.. So I’m not sure that anything has been raised at the court yet. Is this scare tactics by Nolan’s? Any advice would be much appreciated.

    I can almost certainly assist you with this. How much money are you being pursued for? It won't be scare tactics. What is the last date that you have to respond by?

      Thanks very much for getting back to me. The amount I am being pursued for is £5700. The paperwork says it’s in relation to 2 LLoyds TSB accounts (I thought it was HBOS) combined. The return date is 16th July.

        Defend Claim - within 28 days from Service (IF you acknowledged in time)

        If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
