Im uk based and did some video editing work for a German YouTuber who promised me £500 per video and a 25% share of his YouTube income last year. It was a verbal agreement. I did a video for him last year but he has not paid me, nor the 25%. He has roughly £700-£1000 worth of YouTube income per month. He said he felt bad about not paying me in the chat transcript I have with him.
Because he has 1.7 million followers I re engaged with him this year even though he hadn’t paid me (I know a bit silly) and he this time paid me and we agreed £2000 a month and 25%. This is in writing. He has paid the £2000 and 25% but not given me a YouTube print of the earnings.
Last week he asked in text chat (WhatsApp) if I’d like to edit a video where he’d give me £1000 and sent me the video files. I accepted in writing. I wasn’t feeling that well that day, which he knew because I messaged him, so I said I’d download them and there was no problem in getting them done in a weeks time. He said that’s fine. He asked me that night - I hope you’ve downloaded them and I didn’t realise he wanted an answer. The next morning before I wake up he has given the work to someone else. Essentially this is a repeat of the payment defaults in 2025.
I think a contract was formed ie his offer, my acceptance and a financial value set (which is as good as receipt of consideration I understand). Therefore to do me out of that is, I think, breach of contract. The remedy is the contract value.
I think I’d have difficulty getting the 2025 money back but I’ve asked him to pay me the £1000 which he is ignoring. It was the last straw in our relationship when he gave it to someone else when I’ve already accepted it. I’ve also had big communications problems too.
I want to pursue a small claim against him for the £1000 and the failure for breach of contract. He is a rich pilot who works for an a courier airline and my fees are no doubt water of a ducks back to him. I’ve already contacted the company he was doing work for - to tell them about his default with me for the £1000. I may contact his courier firm too.
but what should I do. Do you think I have an easy breach of contract claim plus the lost money in 2025. The issue is I’d have to pursue a smalls claims eu claim.
