  • Default on Credit File

My partner realised that her credit card providers started to reduce the credit limit sometime in September last year. Further digging into the matter, she found that JC International had put a Default on her credit file in April 2025.
To cut long story short, sometime in 2023, she started to get letters from Thames Water for an alleged non payment at a property, which she did not live on the dates of billing in question. Thames water then issued a county court claim for this alleged water bills. They used her current address for all the correspondence. She not even registered for any utilities for the property in question and never lived at that address on the dates mentioned on the claim and previous correspondence. So, she filed a Defence accordingly denying any liability on same grounds.
Later, the legal firm acting on behalf of Thames water sent a discontinuation letter before any court hearing. She received the letter from Thames water in end of March 2025 as well but she is unsure if it was Thames water or the legal firm which sent the second letter as she misplaced it.
However, sometime in late June, she started to receive the letters from JC International and BW legal to pay the debt as they bought the claim from Thames Water. Initially, she did not make any contact with them but when she came to know about the Default on her perfect credit history, she contacted them and requested them to remove the Default immediately. Surprisingly, prior to her first contact with them, both JC International and BW legal were asking her to pay the debt with discount. There was nothing in the correspondence that suggested that they already put a Default on her credit file. There was nothing Default even registered at current address while claiming for an alleged non payment at a different address. Thames Water even don’t supply the water at current address.
She also reported to credit reference agencies, who apparently don’t want to remove the Default mentioning that the Claimant declined to agree to remove the Default.
After further correspondence with JC International and BW legal and SAR, BW legal says they have nothing to provide other than letters both of them sent and an alleged water payment and her details typed on a plain A4 paper.
However, JC International said that they have put her account and SAR indefinitely. So, in short, they will not do anything as long as they want other than destroying her credit report.
As mentioned earlier, the Default appeared on her file in September 2025 and since then, they started to mark as Default with no payment on monthly basis. However, the date of Default is mentioned as 15 April 2025.
On advice from someone, she sent a couple of pre-action letters to JC International, but they simply replied each time that “Thank you for your complaint. We are looking into this matter”
The person who advised to do so is now saying that she should now start a money claim for the damages of around £5,000. After receiving the money claim, they will remove the Default from her credit files.

Please can someone advice that is it correct advice and will not backfire?
