Hello,
I have seen threads where people have filed claims against Amazon but picked the wrong company. It's not obvious what to do because Amazon.co.uk is based in Luxembourg.
My situation is that I bought three items. Amazon sent all three, two in a big parcel and one in a little parcel. They gave both parcels the exact same "one-time password". Their courier delivered one parcel but stole the other parcel however he reported to Amazon that he delivered both.
Amazon is refusing to resend the item or refund because their delivery driver said he delivered both parcels.
Were it not for the fact that I have the whole delivery video recorded from two angles there would be nothing I could do to prove the driver took one of the two parcels away with him.
I explained to Amazon that I have video recordings of their driver NOT delivering the item, but they won't look at the video. They said it was a "not delivered claim" but the driver reported he delivered the parcel so that's that. They apologised for any inconvenience.
I escalated to their Executive Office but they said their records show the time was delivered so they won't be refunding or replacing the item. They would not look at the video recordings either. I sent a notice before action to the customer complaints department at their Principal Place address in London, with a series of still images from the video showing the driver taking one of the parcels away with him, but they completely ignored it.
So now I have to file a claim against Amazon but I need to make sure I get the correct Defendant.
Is this the correct Defendant?

AMAZON EU SARL, UK BRANCH
UK establishment number BR017427
UK establishment office address 1 Principal Place, London, Worship Street, EC2A 2FA
It looks like you can't file claims against Amazon in Luxembourg since Brexit, but surely Amazon can't just keep your money when their delivery drivers steal the parcels?
How should this Defendant be names on a money claim?
Amazon EU SARL?
Or Amazon EU SALR, UK Branch?
Or Amazon EU SARL Trading as Amazon.co.uk?
Or something else??
In case it is important, the parcel was never delivered to me. The driver put the little package on the ground out of sight, asked me to give the code for the big parcel and then as I lifted the big parcel he snatched up the little parcel and ran back to his van, so he stole it from Amazon and not from me. However, Amazon kept the money and won't resend the item (Apple AirPods).
Thank you.
