  • Judgement in default of defence in claim that includes a request for a declaration

Does anyone know how I can obtain judgement in default of defence in a claim that includes a request for a declaration? I know how to apply for a default judgement in a money claim, but the rules do not seem to apply to non-money claims. Many thanks.

I think you will need to apply for summary judgement under CPR Part 24.

I last had to do something like this under the old Rules of the Supreme Court, before the Civil Procedure Rules replaced them.
Lawyer (solicitor) - retired from practice, now supervising solicitor in a university law clinic. I do not advise by private message.

Thanks so much for your reply, Atticus; somehow, I had a feeling that it wasn’t going to be straightforward.
