  • N244 when is it effective?

    Hi - I received a CJJ with a Return of Goods order. I've submitted a N244 for the original order to be stayed and for the CCJ to be set aside. There is also a complaint going through with the Financial Ombudsman Service. I told the other side I was filing this, I provided them a draft statement and a draft of N244. I also provided them my draft counter claim. They decided to come to my property and repossess the goods after learning of my filing of the N244, but before the court had scheduled a date for the hearing. I have written to the court to let them know what has happened, butt my question is are the goods now "lost" because they are back in their possession or do they have to return them? What happens in the scenario that they've sold the goods and then the CCJ is set aside? The item in question is a car!

    Form N244 is an application notice. It means nothing until the court has made a decision on the application.
