  • LTD company sold all my tools

Hi, I have a very good friend who is a mechanic. He was working for a LTD transport company on a self employmebt basis in their premises. All the tools were his and all the parts etc.
Said LTD company was having financial problems and had not paid the rent for 3 months, about £5000 in total.
One day, owners of premises locked the doors with a padlock and stuck a notice on the door saying anybody who enters is tresspassing. They also blocked 4 waggons in with a Range Rover. So, the companys drivers removed the waggons and my friend entered the unit and removed 2 customers cars he also managed to take some tools with him. He did not break anything, he jus unscrewed the bolts. He sent a text message to the director of the Limited company

    Mr xxxxxxxxxx

    Mob: xxxxxxxx

    Email: Xxxxxxx

    Dear xxxxxx

On Tuesday 14th May 2024, you fitted a lock to Unit x Plot xx xxxxxxxx stopping me and others from entering unit x plot x

I understand that this was done in respect of alleged arrears owed by xxxxxx, who leased the building from you and who share the same unit xxxxx

On Wednesday 15th May 2024 at 07:08 I texted you on your number xxxxxxxxxx and informed you " Morning it's xxxxx xxxc mechanic i can't get in there is a padlock on the door can you let me in so I can pick up my tools and the customers car.

At 10:10am You replied "Hi xxxxx I'm on my way to the yard now".

I spoke with you at the yard and your reply was "nothing is being released until the matter with xxxxis resolved" You also stated that in repect of a car that was in the unit under my control, "get the customer to ring me and that you would speak to the customer". I stated that you are unfair with what you are doing. you stated "I am unfair, xxxx is unfair". Because of the stress that I felt, I then walked way.

On Saturday 18th May 2024 08:43 I texted you with the following message, "it's xxxxxx I've been told that you are selling things from xxxxx unit YOU CAN NOT SELL anything of mine give me a time when I can can pick up my things"

on Saturday 18th May at 11:06 you texted me, "Hi xxxxx legal proceedings have started police are involved until the debt is paid nothing will be released. you need to take it up with xxx The unit is xxxx Thank you".

I texted you back Saturday 18th May 2024 at 13:21 and informed you "How can you say legal proceedings have started when you are selling MY things"?

Having taken legal advice I now submit a inventory of my goods at Unit xxxxxxxxxx

I now expect you to take care of my goods under the Torts (Interference with Goods) act 1977, which makes you a involuntary bailee.

I was employed on a self employed basis, and I have no legal connection with xxxxxxxxxcc

I would much rather work with you to resolve this matter to our mutal satisfaction.

If necessary, I will instigate legal proceeedings against you.

Again, I reiterate that It would be benfical for us both to resolve this matter to our mutal satisfaction.

I look forward to hearing from you as soon as possible to reslove this matter.

A a matter of urgency I am serving this letter on you by email.

I will send you a copy of this by registerd post.

    Yours sincerely,

He also sent a inventory of his goods.
SNAP ON TABLE LATHE 1 INCH AIR GUN 2 X DRAPER SOCKET SETS 4 X SNAP ON TORCHES 2 SPARE SNAP ON BATTERIES AND CHARGER 2 X CORDELESS GRINDERS 2 X SPANNER SETS ENGINE HOIST ENGINE STAY SNAP ON INSPECTION CAMERA HALF INCH SNAP ON GUN PLUS 2 CHARGERS 3/8 BATTERY RATCHET 3/8 SNAP ON GUN PLUS CHARGER TIMING TOOL KITS X 6 TYRE REMOVAL MACHINE TYRE BALANCER 17 INCH MERCEDES WHEEL 20 INCH JAGUAR WHEEL 20 INCH RANGE ROVER WHEEL HORSE BOX TRAILER WHEEL 30 TYRES SIZE FROM 13 INCH TO 20 INCH 1 X ELECTRIC GRINDER 1 X ELECTRIC DRILL 1 X ELECTRIC SANDER 4 X STEEL WORK BENCHES 1 X WHEEL BEARING PRESS 1 X 2 POST RAMP 2 X PALLET TRUCKS OTHER MISCELLANEOUS ITEMS BULBS, NUTS, BEARINGS,SEALS ETC. I sent these by txt message and have got no reply. the police attended at the directors request and asked had we stolen anything. Only our stuff so the police did not get involved. My friend rang the police and said she can not do what she is doing. And gave him a crime reference report. So what is my friends next move. Yes he could sue the limited unit company but what about her as a Director as well because she acted outside her Directors responsibilities. She had no certified baliff conduct a inventory of goods inside. She has done this to other units that owed her rent money Now to make matters worse other people had stuff Stored there and it has all been sold. Should the other guy make a complaint to the police? Can my friend include his Include the other guys stuff in his case when he sues because he had care and control of it. he is on benefits now because he can not work with no tools We were thinking of just giving or crowd funding to pay for solicitirs. Value of all the stuff is around £10000 Anybody know of no win no pay solicitors who would take this case on. To be honest everybody who had stuff stolen by her would be happy to let the solicitor Keep all the compensation just to teach her a lesson The mechanic is a well liked guy and no one is giving him hassle over their stuff. Any advice pointers solicitors that could help etc. regards.
