  • MCOL - BAR has been put in place for the defendant?

    Hi all.. Any advice much appreciated.
    I have helped a friend start an MCOL case after sending a Letter Before Action. We were notified yesterday on the MCOL site that a "BAR has been put in place" for the defendant. But it doesnt say why or give a clue as to what the next steps are?
    We sent supporting proof/documentation with the Letter Before Action, should we also send this to MCOL and if so when and how?

    Hi there

    So you issued a Claim via MCOL. So depending on time frames, if the Defendant hasnt replied to the Claim and you havent requested judgment then the Court will stay the Claim.

    My recommendation is if you are at the time when you can request judgment, get a request for judgment on the appropriate Court form into the Court

      A BAR has been put in place so you can't get a judgement whilst court documents are processed.
      There was a thread started on this topic back in 2014
      You just have to wait

        Similar happened to me, as the defendant couldnt place a defence (system issues) so a bar was put in place so judgement by default could not be placed.

        Acknowledge Claim - within 14 days from Service

        Defend Claim - within 28 days from Service (IF you acknowledged in time)

        If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
