    Hi
    i issued a claim against a company after 10 months of them ignoring emails and just want my money refunded for an order that was delivered inches shorter than ordered and wonky.
    Long story short the managing director keeps emailing me numerous times a day making an offer ‘Without prejudice’ and then sending another email immediately after withdrawing the offer but without the’Without prejudice ‘ title. He’s been emailing until 23.04pm telling me to ‘google the meaning of without prejudice’.. I know the meaning of it and have already agreed to accept his offer 3 times but he withdraws it minutes later and says if he has to attend Court then he will request £1200 In expenses. I have accepted his offer 3 times and copied the Court in as per the Court order stating any correspondence must be copied to them and the defendant but he says he doesn’t have to copy the Court into our correspondence as he’s put the header‘Without Prejudice’Any help would be greatly appreciated. Original claim was for £340 and i’ve accepted his offer of £150 but he’s withdrawn it under ‘without prejudice’ ??

    Any communications with the words 'Without Prejudice' shouldn't be submitted to the Court.

    It's something the Court doesn't need to know as they are communications between the 'parties', often carried out to try and settle the case.

    The only time the Court would be interested in them is after the case, as they may have a 'bearing' on the costs issue.
