    Evening

    I want to amend my particulars of claim & also claim amount. All the facts remain the same apart from the defendant solicitor has requested that the court order it be done better and that I plead a recognised cause of action.

    So I have amended my particulars of claim and filled in the n244 form and I want to add 8% interest as the cost to fix the damage will be increasing. I wanted to add on to the stress and worry it has caused over the last 2 years. Should I also fill in a new n1 form with the new amounts to go with the amended particulars of claim?

    Phone 0300 123 1372 (different number for MCOL) and speak to court staff. They can advise on court procedures but not provide legal advice. You may need to submit a new claim.
    Sounds as if you have got to provide more info in your claim regarding breach of contract or misrepresentation referring to the legislation and how the defendant breached or misrepresented the contract.
    Refer to the statute when you claim interest. Any award for stress is likely to be minimal if at all.
