  • Solicitors cost at court hearing.

    I understand solicitors cannot charge for their time when dealing with a complaint from a client.
    If a client pursues a small claim action against the solicitors and looses the case at a court hearing does this rule still apply?

    A claim is not a complaint, it is legal action. Small Claims Track costs rules will apply.

      Thanks Atti, as I suspected.
      Although solicitors costs are not usually allowed in small claims I guess that when one of the parties is a solicitor and is successful they can claim their usual hourly rate -possibly less any profit margin.

        Practice Direction 27A limits the amount
        " for the loss of earnings or loss of leave of each party or witness due to attending a hearing or staying away from home for the purpose of attending a hearing, a sum not exceeding £95 per day for each person"

        Don't see why a solicitor should receive different consideration
