  • Expert Evidence - do I need to apply for Court's permission

    Hello everyone,


    I got a Court order to provide a medico-legal report to support my case.
    I have a number of medical reports and other documents that I will submit to the medical expert for evaluation.
    The problem is that some of these documents are falsified. They are backdated and the content in them is incorrect.
    I cannot let these false documents be a source of my medical report and to prove the falsification I intend to instruct an IT Expert.

    Now to the question I want to ask you. For that IT report, do I need to apply for Court's permission?
    I understand from the CPR 35 that no expert evidence is admissible without Court's permission but I am a little bit unsure in this case since it is needed for another report that was already ordered by the court.

        the answer to the OP's question is yes, he needs permission.
