  • Statement of Truth - Validity

I am a Claimant in a Small Claims Court case.
The Defendant is a large company with its own legal department.
This is the Statement of Truth given with its Defence submission. (my italics)

    STATEMENT OF TRUTH
The Defendant believes that the facts stated in this Defence are true. I understand that
proceedings for contempt of court may be brought against anyone who makes, or causes to
be made, a false statement in a document verified by a statement of truth without an honest
    belief in its truth.
    Signed xxxxxxxxxx
    Name: xxxxxxxxx
    Position: Consumer Claims Paralegal
    Dated this xxxxxxxx October 2022

Having referred to PRACTICE DIRECTION 22 – STATEMENTS OF TRUTH
I believe that I understand is incorrect and should have been The Defendant understands.
I also believe that the statement should have been signed by a person holding a senior position
in the company, stating the office or position held, and not by a paralegal.

Am I correct? If not, can you explain why.
    Thanks
