  • Enforcement of Scottish Debt in England.

    Hello.

    I have a Decree issued by a Sheriff Court which orders the Respondent who lives in England to pay me a sum of money. I live in Lockerbie.

    In order to enforce this judgement in England, I have to get a Certificate of Money Provisions from the Court. To get the Certificate, I have to apply in writing to the Court with an Affidavit sworn by a Notary Public.

    Has anyone had any experience of this?

    The guidance given by the Scottish Court is to use a Solicitor but I cannot find a firm that has done this before or a Notary who has prepared such an Affidavit.

    Any suggestions on the way forward would be most appreciated.
