  • Parking Company - DSAR Claim Help Requested

    I have been pursued by a parking company and have requested all data from them that they hold on me. I have also requested all data from DVLA. 2 weeks later neither has responded and neither has requested clarification or identification. I suspect I will be ignored and I want to be ready for the next step which I understand is a complaint to the ICO. However ICO is notoriously slow and fickle, and I'd also like to begin the process to initiate an action in court for this non-response, and would appreciate some guidance with the process. I also plan to send a warning letter after their 30 days are up, demanding a substantive response within 7 days, then proceed. Is this the correct approach?

    You can send a letter, it is called a letter before action and will need to include sufficient detail about the dispute. I would suggest you do some research as to what to include.

    Since the DVLA and the Parking Co. have 30 days to respond, you will need to allow them that full time. The DVLA will be represented by the Government Legal Department so if you plan on sending an LBA then you would be wise to send it to the DVLA Swansea address and also the the GLD address: link here.

    Same approach for the Parking Co.

    You won't be able to use the Money Claims Online service because that only deals with claims about money whereas what you are asking for is an injunction order from the court to force the DVLA and the Parking Co. to comply with your request. You will have to use Form N1 and send it to your local court or if you are claiming compensation aslo, then you can send it to the County Court Money Claims Centre in Salford, Manchester (CCMC)
