Dear friends at LegalBeagles,
I intend to make an application to strike-out the defence to my claim for not complying with the rules.
If the judge decides that the defendant can correct his defence instead of striking the whole defence out, can the cost of making the application still be recovered from the defendant?
Or would it be smarter to do something less drastic in this case?
Many thanks in advance.
