  • Starting a claim against a garage

    I took my 12 month old company Ford Focus for repair to my locals main dealer and after a month of them having the car went to collect something out of it.
    I found the car in the car park a burnt out shell…after trying to blame ford originally they admitted full liability. They promised to replace all my belonging and I made a list that they accepted and even replaced the cycle carrier a few weeks later so I could go on holiday.
    last week I sent them an email saying if it wasn’t sorted I will take legal action at the small claims court. They contacted me on Wednesday and asked for bank details , said would process on Thursday and would be in my bank Friday.
    after stalling tactics they are now asking for receipts for things bought in 2014 to 2018…I have supplied photos of the items either in the car after being burnt out or before as some things did not survive the fire.
    now they are ignoring all contact.

    what should my next strip be ?

    I suspect it is their insurance company asking for receipts, but they are being a tad unreasonable.

    As you have already warned them of impending legal action,I would write (first class post with free certificate of posting from PO) (or email) telling them they have 7 days in which to fully reimburse you for the lost items before you initiate court action.

    List the items, together with their replacement cost and where possible include photos.

    And on day 7 commence action if no response

      Thanks for your reply ,

      they had a list (that they requested ) with all items, cost to replace and even where from at the cheapest price and said all was ok, photos of all items, they can clearly see the items.

        So tell them no receipts but money in 7days or court proceedings will be initiated

        Acknowledge Claim - within 14 days from Service

        Defend Claim - within 28 days from Service (IF you acknowledged in time)

        If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
