Court orders 2nd defendant to be added to proceeding

  • Court orders 2nd defendant to be added to proceeding

    I made an online civil money claim. I then requested to add a 2nd defendant by completing a N244 application form.

    There was a telephone hearing by the judge on whether i could add a 2nd defendant last week.

    The judge ordered the 2nd defendant to be added to the proceedings.

    The judge asked me to file the claim and particulars of claim to 2nd defendant along with my original claim, the 1st defendants defence filed, my n244 application together with my statement of facts sent with the N244 form.

    The judge also asked me to send certificate of service with form N215 to the court.

    Questions:

    1) Do i need to download a new application form or do i wait for courts to send me the relevant application forms?
    2) Do i need to send the completed application form and particulars of claim regarding 2nd defendant directly to the court or do i need to send these directly to the 2nd defendant?

    Hi there

    You are responsible for complying with the requirements of the Civil Procedure Rules when you add a party. The Court wont send you the forms, its your responsibility to find and complete them.

    Have you read the Civil Procedure rules on substitution or adding parties?
