  • Can you claim the freeholder to pay for damaged vehicle in the building communal area

    I am a leasehold in a gated community managed by a property management company. The front gate is continuously broken, allowing anyone to come in without a key card or a pin code. I have informed the management company about the gate issue via email and phone calls many times over the past two months. However, they haven't done anything since them. Last night, someone got into the property, tried to steal my moped and damaged it.
    I want to claim the management company to pay for all the costs because they have dealt neglectfully with it.
    What can I do? Can I fill a claim court against the management company for that?
    Any advice is welcome!

    You could possibly make a claim for negligence against the freeholder/management company if the property had been advertised as "secure",
    but whether or not you would be successful is another matter.
    If your moped is insured they might pay your excess, just to dispose of the matter.
