    Hi sorry my original thread , i received this court letter the other day i have no experience dealing with issues like this , i took out a dongle when i was 18 * 23 now , i dint pay it i was stupid and got internet and forgot, after getting this letter i panicked and rang lowell to sort out a payment plan but they told me i will have a immediate CCJ , have to pay £40 then we can discuss the payment plan, i hung up , i've stated i want to defend this claim and sent my acknowledgement but im unsure if i have any grounds to stand on after calling them , can anyone help me? i dont understand the court system , letters or anything :/

        Hi &welcome to LB.

        What were the payment arrangements?
        Were they governed by the Consumer Credit Act? (You would probably have signed a finance agreement if so).

          Hi thanks for the reply, I can't remember as I signed up online, i don't think I made any payments as I had internet on within a month it was too long ago to remember

            Ok

            If it were me I'd send a CPR 31.14 letter to the solicitors for disclosure of evidence, plus a SAR to 3(Three....ie Hutchison).
            (Example templates at top of this thread).
            If you post up the Particulars, we could suggest what to ask for re the 31.14.
            Keep copies, get proof of posting.

            Acknowledge Claim - within 14 days from Service

            Defend Claim - within 28 days from Service (IF you acknowledged in time)

            If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
